As condominiums and planned communities continue to evolve, so do the transactional issues between buyers and sellers. Learn about the unique and critical issues impacting the sales of homes in common interest communities involving builder-developers, re-sales, the agreement of sale, title issues and “Over 55” regimes. Explore the emerging statutory and decisional law effecting such sales, and take away practical tips to ensure a successful closing in your transaction. Focus on the purchase, sale and applicable law. Our experienced faculty will use an interactive approach to focus upon the issues involved in these purchases and sales. They’ll examine: initial sales from the builder-developer, including required disclosures and warranties; re-sales of existing homes and the buyer’s right of rescission; specific provisions in the parties’ agreements of sale and unique title issues; what to look out for in adult 55+ regimes, including distinctions with continuing care retirement communities (CCRCs) and related issues.
